Terms of Service

These Terms of Service govern your access to and use of LaunchPoint APP. By using the platform, you agree to be bound by these terms. If you are using LaunchPoint on behalf of an institution, you represent that you have the authority to bind that institution to these terms. Questions? Email legal@launchpointapp.co.

1. Acceptance of Terms

By accessing or using LaunchPoint APP at launchpointapp.co (the “Platform”), you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legally binding agreement between you and LaunchPoint APP, operated by Rachel Jackson, a sole proprietor (“LaunchPoint,” “we,” “us,” or “our”).

If you are accessing the Platform on behalf of an institution, school district, or other organization (“Institution”), you represent and warrant that you have the legal authority to bind that Institution to these Terms. In that case, “you” refers to both you individually and the Institution you represent.

2. Definitions

  • “Platform” means LaunchPoint APP, including all websites, applications, features, tools, and services operated by LaunchPoint.
  • “Student User” means any individual who creates an account to access the student-facing features of the Platform, including pathway planning, degree audit, and document management.
  • “Institutional User” means any authorized employee, administrator, or representative of an Institution who accesses the institutional features of the Platform.
  • “Institution” means a college, university, community college, school district, or other educational organization that has entered into an agreement with LaunchPoint for institutional access.
  • “Content” means any information, data, documents, or other material you submit to, upload to, or create within the Platform.
  • “Education Records” has the meaning given to that term in the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g.
  • “AI Features” means pathway modeling, risk flagging, planning recommendations, and any other feature powered by artificial intelligence or machine learning.

3. Eligibility

You must be at least 13 years old to use the Platform. If you are between 13 and 17, you must have parental or guardian consent to use the Platform. By registering, you represent and warrant that you meet this requirement.

The Platform is designed for individuals who are currently enrolled in or planning to enroll in post-secondary education, and for employees or administrators of educational institutions. Using the Platform for purposes outside this scope is a violation of these Terms.

You must have the legal capacity to enter into a binding agreement under applicable law. If you are using the Platform on behalf of an Institution, you represent that you have the authority to do so.

4. Your Account

Registration.

To access Platform features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

Account security.

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at security@launchpointapp.co if you suspect unauthorized access to your account. LaunchPoint is not liable for any loss or damage arising from your failure to safeguard your credentials.

One account per person.

Each person may hold only one student account on the Platform. Creating duplicate accounts to circumvent restrictions or gain an unfair advantage is prohibited.

Account ownership.

Your student account is yours. It is not owned by or transferred to any Institution, even if that Institution sponsors or facilitates your access. You retain ownership of and access to your account independent of any institutional relationship.

5. Student Accounts — Rights and Responsibilities

What you can do.

With a student account, you may use the Platform to plan your academic pathway, track your progress toward degree completion, store and manage academic and career documents, connect external academic platforms, interact with AI-powered planning features, and connect with your institution where applicable.

Your responsibilities.

You are responsible for the accuracy of information you enter into the Platform. LaunchPoint cannot verify the accuracy of degree requirements, course equivalencies, transfer credits, or academic policy information from third-party sources. You should always verify AI-generated pathway recommendations against your institution's official degree requirements and with a qualified academic advisor.

Institutional connections.

You control which institutions can see your individual account data. You can grant and revoke institutional visibility at any time through your account settings. Connecting to an institution does not give that institution ownership of your account or your data.

6. Institutional Accounts — Rights and Responsibilities

Institutional agreements.

Access to institutional features of the Platform is governed by a separate institutional agreement executed between LaunchPoint and the Institution. In the event of any conflict between these Terms and an institutional agreement, the institutional agreement controls for matters specific to institutional access and obligations.

Authorized use.

Institutional Users may only access student data consistent with the permissions granted by students and the terms of the institutional agreement. Institutional Users must comply with all applicable laws, including FERPA, and may not use student data for any purpose outside the educational mission and the purposes described in the institutional agreement.

Administrator responsibilities.

The Institution is responsible for managing Institutional User accounts within its organization, including granting and revoking access. The Institution is also responsible for ensuring its Institutional Users comply with these Terms and applicable law.

Data handling obligations.

Institutions accessing cohort analytics or individual student data through the Platform must handle that data in compliance with FERPA and any applicable federal program requirements (Title III, Title IV, Title V, TRIO, NSF REU, and others). Institutions may not re-disclose, sell, or transfer student data obtained through the Platform to any third party without appropriate legal authorization.

7. Education Records and FERPA

LaunchPoint operates as a “school official” with a “legitimate educational interest” under FERPA, 34 C.F.R. § 99.31(a)(1), when providing services directly to educational institutions under an institutional agreement. In that capacity, LaunchPoint may access student education records as authorized by the institution, subject to FERPA's requirements.

When Student Users directly upload, enter, or connect their own education records to the Platform, they are directing LaunchPoint to access and process those records as their authorized agent.

In all cases, LaunchPoint will use education records only to provide the Platform services and will not disclose, sell, or use student education records for any purpose inconsistent with FERPA or these Terms.

Students have the right to access, review, and request correction of their education records stored in LaunchPoint, and to withdraw consent for institutional access at any time. For questions about FERPA rights, contact privacy@launchpointapp.co.

8. Connected Third-Party Services

LaunchPoint may allow you to connect third-party academic platforms, student information systems, or learning management systems. When you connect a third-party service, you authorize LaunchPoint to access your data from that service on your behalf.

Your use of any third-party service remains subject to that service's own terms and privacy policy. LaunchPoint is not responsible for the actions, content, or data practices of any third-party service, and does not endorse any third-party service.

LaunchPoint does not guarantee the continued availability of any third-party connector. Third-party services may change their APIs, revoke access, or discontinue service at any time. If a connector becomes unavailable, it does not affect your rights under these Terms or the data already in your LaunchPoint account.

You may disconnect any third-party connection from your account settings at any time.

9. AI Features — Scope and Limitations

AI features are informational tools.

LaunchPoint uses artificial intelligence and machine learning to power pathway modeling, risk flagging, and planning recommendations. These features are informational tools designed to support your decision-making. They are not official academic advising and do not constitute guaranteed outcomes.

AI outputs are not authoritative.

AI-generated pathway recommendations, risk scores, and planning suggestions may not reflect your institution's current official degree requirements, course availability, credit transfer policies, or academic standing determinations. You must verify all AI outputs against your institution's official records and with a qualified academic advisor before making any academic decisions.

LaunchPoint is not liable for AI errors.

LaunchPoint is not liable for any academic, financial, career, or other consequences arising from your reliance on AI-generated outputs. You use AI features at your own risk and are solely responsible for any decisions you make based on them.

No AI training on your education records.

LaunchPoint does not use your education records or identified student data to train, fine-tune, or improve any AI or machine learning model. See our Privacy Policy for full details.

10. Acceptable Use

You agree to use the Platform only for its intended educational planning purposes and in compliance with all applicable laws and these Terms.

You may not:

  • Use the Platform for any illegal purpose or in violation of any law
  • Upload or transmit any content that is infringing, defamatory, obscene, harassing, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Platform, other user accounts, or LaunchPoint systems
  • Use automated means to access, scrape, or extract data from the Platform without prior written permission
  • Introduce malware, viruses, or other harmful code
  • Misrepresent your identity, credentials, or institutional affiliation
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Platform
  • Interfere with or disrupt the Platform or the systems it operates on
  • Use another user's account without their explicit permission
  • Sell, rent, or otherwise transfer your account access to another party
  • Access or use any student's education records beyond the scope permitted by FERPA and these Terms

We reserve the right to suspend or terminate accounts that violate these restrictions.

11. Intellectual Property

LaunchPoint's property.

The Platform, including its design, software, features, algorithms, AI models, and all LaunchPoint-created content, is owned by LaunchPoint and protected by copyright, trademark, trade secret, and other applicable intellectual property laws. These Terms do not grant you any license to LaunchPoint's intellectual property except the limited right to use the Platform as described herein.

Limited license to use the Platform.

LaunchPoint grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended educational planning purposes during the term of your account. This license may not be sublicensed.

Feedback.

If you provide feedback, suggestions, or ideas about the Platform, you grant LaunchPoint a non-exclusive, royalty-free, perpetual, worldwide license to use and incorporate that feedback without obligation or compensation to you.

12. Your Content

You own your content.

You retain all ownership rights in the content you submit to the Platform, including your academic records, planning documents, and vault files. LaunchPoint does not claim ownership of your content.

License to LaunchPoint to provide the service.

By submitting content to the Platform, you grant LaunchPoint a limited, non-exclusive, royalty-free license to store, process, and display your content as necessary to provide you with the Platform services. This license exists only for the purpose of operating the Platform on your behalf and terminates when you delete the content or close your account.

Accuracy.

You are responsible for the accuracy of content you submit. LaunchPoint is not responsible for errors in AI outputs caused by inaccurate information you provide.

Content restrictions.

You may not submit content that you do not have the right to submit, that infringes any third-party intellectual property rights, or that contains malicious code or material.

13. Fees and Payment

Free access during pre-launch.

Access to the Platform during the pre-launch and early access phases is currently free. LaunchPoint reserves the right to introduce paid features, subscription plans, or institutional pricing in the future.

Notice of changes.

If we introduce fees for any feature currently provided free of charge, we will give you at least 30 days' advance notice before the change takes effect. Continuing to use the affected feature after the fee takes effect constitutes your acceptance of the new pricing.

Institutional pricing.

Institutional access is subject to the fees and payment terms set forth in the applicable institutional agreement.

14. Availability and Service Changes

LaunchPoint is a growing platform and we are constantly improving it. We may modify, update, suspend, or discontinue any feature, aspect, or the Platform as a whole at any time, with or without notice. We will make reasonable efforts to notify you of material changes in advance when practicable.

LaunchPoint does not guarantee uninterrupted, error-free, or continuously available service. We may take the Platform offline temporarily for maintenance, upgrades, or unexpected issues. We are not liable for any loss or inconvenience caused by service interruptions or changes.

If LaunchPoint discontinues the Platform entirely, we will provide you with reasonable advance notice and a mechanism to export your data before shutdown.

15. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, OR NON-INFRINGEMENT.

LAUNCHPOINT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AI-GENERATED PATHWAY RECOMMENDATIONS, RISK ASSESSMENTS, AND PLANNING OUTPUTS ARE PROVIDED WITHOUT WARRANTY OF ANY KIND. LAUNCHPOINT MAKES NO REPRESENTATION THAT AI OUTPUTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR ACADEMIC DECISION.

Some jurisdictions do not allow the exclusion of implied warranties, in which case the above exclusions may not fully apply to you.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LAUNCHPOINT, ITS OPERATORS, AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF ACADEMIC OPPORTUNITY, FINANCIAL LOSS, OR EMOTIONAL HARM, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF LAUNCHPOINT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL LAUNCHPOINT'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO LAUNCHPOINT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

These limitations apply to the maximum extent permitted by law. Some jurisdictions do not allow the limitation of liability for certain types of damages, in which case the above limitations may not fully apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless LaunchPoint and its operators, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform in violation of these Terms
  • Content you submit to the Platform
  • Your violation of any applicable law
  • Your violation of any third-party rights, including intellectual property or privacy rights

LaunchPoint reserves the right to assume exclusive control of its own defense in any matter to which you are required to indemnify LaunchPoint, at your expense.

18. Termination

By you.

You may close your account at any time by emailing hello@launchpointapp.co or through the account settings when that feature becomes available. Upon closure, your personal data will be deleted in accordance with our Privacy Policy.

By LaunchPoint.

LaunchPoint may suspend or terminate your access to the Platform at any time for any reason, including but not limited to violation of these Terms, fraudulent or illegal activity, or extended periods of inactivity. We will provide reasonable notice where practicable, except where immediate termination is required to protect the Platform, other users, or third parties.

Effect of termination.

Upon termination, your license to use the Platform is revoked. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will continue to apply.

19. Dispute Resolution and Governing Law

Governing law.

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. LaunchPoint APP is operated by a sole proprietor based in California.

Informal resolution first.

Before initiating any formal dispute process, you agree to contact us at legal@launchpointapp.co and attempt to resolve the dispute informally for a period of 30 days. Many issues can be resolved quickly through direct communication.

Venue.

If informal resolution is unsuccessful, you agree that any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of California. You consent to the personal jurisdiction of those courts.

Class action waiver.

To the fullest extent permitted by applicable law, you waive the right to participate in any class action lawsuit or class-wide arbitration against LaunchPoint.

Time limit on claims.

Any claim arising from or related to these Terms must be filed within one year after the event giving rise to the claim, or the claim is permanently barred. This limitation applies regardless of any applicable statute of limitations.

20. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top and notify you by email or a prominent notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Platform and may close your account.
